汉谟拉比法典(code of Hammurabi)简介极其内容摘要.
汉谟拉比法典(code of Hammurabi),一七○○年出于巴比伦;它刻在一根高225米,上周长165米,底部周长190米的黑色玄武岩柱上,共3500行,正文有282条内容,用阿卡德语写成.它是世界上最古老、最完整的法典.是汉谟拉比为了向神明显示自己的功绩而纂集的.
我认为每一部法典都是映射同时期人类所犯罪孽的镜子.正是因为这部法典最古老,所以它所映射的人类本性中所潜藏的原始欲望才最透彻.

汉谟拉比法典有282条法律条款,包括刑事法及有关占有奴隶、结婚和离婚、偿还债务和支付工资等方成的法律。一些法律听起来还很合理:如第233条规定:“倘若一个建筑者建造一幢房子,……而工程不完善,……这一工程应由该建筑者本人出资修缮。”
刑罚是严厉的。一条法律规定:“倘若一个人挖出任何自由民之眼,则应同样挖出其眼。”但是挖出奴隶的眼睛就不会处罚得这么重,只需支付一定的罚金即可。
汉谟拉比的雕像。在颁布法典的同时,他还建立了一个巴比伦宗教,来代替多神崇拜。
汉谟拉比法典雕刻在一块石碑或者说是石柱上。顶部是汉谟拉比与巴比伦的正义之神沙玛什的雕像。
汉谟拉比法典是公元前十八世纪古巴比伦王国国王汉漠拉比颁布的《法典》,它是用楔形文字刻在一个高二点二五米,周围约一米五的石柱上,史称《石柱法》。这石柱是黑色玄武岩,质地坚固。石柱的上方刻着一坐一站两个浮雕人像:坐着的是太阳神沙马什,右手握着一根短棍,叫做"权杖",是统治权力的标志。站着的是汉谟拉比,他双手打拱作朝拜状。
这个浮雕的内容很清楚,那就是宣称石柱上所刻的法律条文是汉谟拉比从太阳神那里接受过来的,太阳神正把象征司法权力的权杖交给汉谟拉比,通过这根权杖,汉谟拉比将把抽象的法律条文变成具体的至高无上的国家权力。
《法典》分前言、正文、结语三部分。前言和结语宣扬他的权力来自神授,赞颂他统一两河流域的文治武功,是当之无愧的"宇宙四方之王",制订法典是为了"在世界上发扬正义",同时对破坏法典的人进行了神的诅咒。
《法典》正文凡二百八十二条,内容有如下部分:
一、关于诉讼审判的规定(1至5条):
其中第二条规定十分有趣,在法庭上,当一方控告另一方犯有某种罪行,然而提不出证据,被告一方也拿不出反驳的证据。这时,法官便会宣布把被告一方扔进幼发拉底河中,如果沉溺了,证明被告一方有罪。没收其全部家产归原告一方;假如不被淹死,则证明无罪。那就处死原告一方,同时把原告一方的财产没收归被告一方所有。这叫做交河神审判。
二、关于保护私有财产的规定(6至126条):
其中规定盗窃或隐藏他人奴隶的人处以死刑;欠债到期不还的人,责令其妻子和儿子两人到债主家里充当奴隶三年,第四年恢复自由。
三、关于婚姻、家庭与财产继承(127至195条)。
四、关于人身保护和"同态复仇法"(196至214条)
其中规定以眼还眼,以牙还牙。打瞎奴隶的眼睛同打瞎耕牛的眼睛一样处理,杀死奴隶同杀死耕牛一样不偿命,只赔偿经济损失。建筑设计师设计的房屋倒塌,若压死了屋主,把建筑师处死,若压死的是房主的妻子或儿子,就把建筑师的妻子或儿子处死。
五、关于劳动、报酬、工具和责任事故的追究(215至241条)。
六、租赁牲畜、船只以及佣工和报酬(242至;277条)。
七、关于奴隶的规定(278至282条)
法典明确规定:奴隶是不受法律保护的工具和财产,奴隶不属于人的范畴。
法典还规定:在自由民中间也有严格的等级贵贱的区别。有权的自由民称"阿未路",无权的自由民称"木什京路"。
汉谟拉比法典是古巴比伦王国权力总和的抽象,它通过君主专制和神权政治相结合而变成实际的统治权力。这种权力的最大特点是"法有贵贱"、"刑有等差。"汉谟拉比法典虽是奴隶主阶级的法律,但在距今三千多年前能够有这样一部或多或少体现法制精神的法典应该算是人类的骄傲

135. If a man be taken prisoner in war and there be no sustenance in his house and his wife go to another house and bear children; and if later her husband return and come to his home: then this wife shall return to her husband, but the children follow their father.
